Judge: FDA's Premarket Review Process for Premium Cigars Was "Completely Mishandled" |
The U.S. District Court for the District of Columbia has blocked the U.S. Food and Drug Administration (FDA) from requiring that premium cigar brands be submitted to the agency for Substantial Equivalence review. |
Super short version: when FDA updated their premium cigar regulations in 2016, the agency wanted cigar companies to prove that any new product (i.e., a cigar) was "substantially equivalent" to an already approved or grandfathered cigar on the market. But what that meant, no one really knew – not even FDA. So the cigar makers sued, and the judge dinged the feds on it. The judgement is a win (for now) for the cigar industry, since FDA failed to engage in "reasoned decision-making" regarding premium cigars. |
Substantial Equivalence was looking to be the most expensive and labor-intensive procedure for bringing new cigars to market. Not only was this going to stifle new cigar development, but it could even put companies out of business. "I think it's a giant burden and weight off our backs," said Rocky Patel. "Finally we can focus on what we do best." |
Even if it's only temporary, the bottom line is there will be little, if any, change in the cigars you buy - and there's a chance you might see even more new releases entering the market that were originally being held back. |

Now, the bad news...we are sad to report that "Tobacconist t o the World" Nat Sherman is shutting down its cigar business after 90 years. The company says "the COVID-19 pandemic created new challenges that were unfortunately too big to overcome." |
Altria (owner of Marlboro) acquired the company from the Sherman family about 3 years ago, primarily for their boutique cigarette brands. And though Nat Sherman cigarettes will still be made moving forward, the premium cigar business will wind down by the end of September. |
